Terms & Conditions

I agree to be bound by the following terms and conditions in relation to storage of my boat at Comen Ltd’s Jurien Marina boat storage facility (“compound”)

1. I am the owner of the boat identified on the application form OR I am authorised by the owner of the boat identified on the application form to enter into this storage arrangement.

2. I agree that Comen Ltd may vary these terms and conditions and the rates payable for storage at any time without specific notice to me and I agree to be bound by such change on and from the time of that change. I also agree that it is my responsibility to read all signage in the compound and check the notice board and internet site periodically for any such change.

3. I am responsible for parking and removing my boat and will:
(i) follow all road signs and directions as to traffic flow;
(ii) park it only in my designated/numbered bay; and
(iii) use all due care and skill in doing so.

4. I acknowledge that my boat is stored entirely at my own risk, my entry into the compound is at my own risk and while Comen Ltd will take all care I acknowledge that it has no liability in tort
or contract or otherwise (including in negligence) for:
(i) any act or omission be it whether deliberate, negligent or otherwise and whether by itself, its officers or agents;
(ii) any act or omission by any third party (including other users of the compound whether deliberate, negligent or otherwise and whether by itself, Its officer’s servants or agents);

5. I agree to indemnify Comen Ltd in relation to any and all claims against it for loss, damage and expense sustained by any person arising out of any act or omission by me (including any legal costs
incurred in defending such claim).

6. Children are not permitted within the compound unless strictly supervised by a parent.

7. Animals are not permitted within the compound unless strictly kept within the vehicles.

8. Intoxicated persons are not permitted within the compound.

9. One vehicle per vessel only permitted in the compound and a speed limit of no more than 5 KPH is required. A parked vehicle must be clear of all access ways. Secured in gear and handbrake on.

10. Disposal of oils/greases, fuel and rubbish is the responsibility of the vessel owner/operator and is not to be left in the compound. The expected procedure for disposal of oils/greases, fuel and rubbish is posted on the notice board. Immediately clean up spills thoroughly.

11. Boat owners are responsible for the rented hardstand site that must be kept clean and tidy at all times and free of fuel and rubbish.

12. Tools, equipment, leads etc are not to be left lying around the compound or under vessels and are the responsibility of their owner.

13. The compound is to be used only for the storage of my boat and not any other item or thing or for any activity or purpose or to stay other than leaving or retrieving my boat. It may be used for recommended maintenance approved by Comen Ltd and boat equipment safety checks. It may not be used for other activities including but not limited to refueling, cleaning, other maintenance or repair of my boat.

14. I acknowledge that Comen Ltd does not have to release my boat from storage if there are any outstanding storage fees.

15. I will make all persons I bring to the compound aware of the location of Comen Ltd emergency assembly points in the event of any emergency or fire.

16. Emergency assembly point locations are:
(i) Trailer park entrance, Breakwater Drive.
(i) Trailer park exit, Harbour Drive.

17. I will make all persons I bring to the site aware of the location of fire fighting equipment (the location of which is on the notice board).

18. I accept that Comen Ltd retains the right to require and any person with me to immediately leave the compound (including my boat).

19. I am aware the privacy act 1988 may prevent Comen Ltd from disclosing personal information about me without my approval. i authorise Comen Ltd to provide my personal details to persons who it considers, in its absolute discretion, to have a claim against me or a person I brought into the compound in respect of damage to their person or property arising out of any act or omission by me or a person accompanying me occurring in the compound.
